                                Terms and Conditions of Purchase from Wheelchair Apparel, LLC

IT IS IMPORTANT THAT YOU READ ALL THESE TERMS AND CONDITIONS CAREFULLY. These Terms and Conditions of your Purchase(s) are legally binding and your purchase is subject to these Terms and Conditions.
By using this site, or purchasing by any other method including email, phone call or any other form of purchase you agree to, and accept these terms and conditions. If you do not agree to these terms and conditions, please do not use the Site or place an order in any manner whatsoever. Wheelchair Apparel, LLC reserves the right, at its discretion and without notice, to change, modify, add or delete portions of these terms and conditions at any time at its sole election. Please check these terms and conditions periodically for changes. Your use of the Site and purchase of Wheelchair Apparel products following the posting of changes to these terms and conditions constitutes agreement to, and acceptance of, any such modifications.
Use of credit, debit or other card or other form of payment.
In making a purchase, you agree that you are the card or account holder for your account or have express permission of the card or accountholder to use their card or account as a payment method.
Use of Paypal, Venmo and other forms of electronic payment.
If you are using the option of payment through PayPal, please note that it generally takes PayPal 3 to 5 business days to confirm payment. In such event, your order will not be processed until payment is confirmed.
Third party transaction fees.
Wheelchair Apparel is not responsible for any outside transaction fees or charges that may be incurred by making a purchase through Wheelchairapparel.com or directly from a Wheelchair Apparel representative whether by email, phone order or any other form of purchase. This includes but is not limited to, NSF charges, foreign transaction fees, exchange rate costs, or any charge that is not directly invoiced by, through or related to Wheelchair Apparel, LLC and a purchase therefrom.
Non Cancellation. Custom manufacture of Products.
Your order will be custom manufactured based on the information you provide to us. Therefore, once payment is made and your order is immediately included in the production list, your order cannot be cancelled, notwithstanding that your order may be produced after the anticipated delivery date.

Product review and acceptance.
Because this apparel is custom made based upon the information you provided and further because you were not present for verification of the information you provided, there may be some allowance or variance in the manner in which the apparel fits. These relatively minor issues are not cause, permission or agreement to return the apparel. Notwithstanding the above, if you not satisfied with the fit, you must notify us of the issue within calendar 10 days. Failure to do so will forfeit any claim you may have had.
When your pants/shorts arrive, inspect the product(s) to insure they include all custom additions you ordered such as pockets, closures, buttons, zippers, loops and/or other custom additions. Also, please try the apparel on for fit to make sure that and you are satisfied with the fit.
Proprietary and Intellectual Property.
All information provided to you whether through the website, text, email, collateral material, phone call, video call, advertising or any other communication including images, photos, designs, videos, phrases, testimonials, visuals, copyrights, the website itself, trade names, trade styles, logos, technical information, descriptions and each and every other similar element or component, is Intellectual Property of Wheelchair Apparel, LLC.
Third Party Suppliers and Purveyors.
Wheelchair Apparel, LLC is not responsible for products, goods and services provided to it by third party purveyors and suppliers, and absent intentional and willful misrepresentation and gross negligence on the part of Wheelchair Apparel, LLC, your purchase constitutes a full release and hold harmless of and from any claims against Wheelchair Apparel, LLC including but not limited to claims for product liability, provided however that you do not waive any statutory rights you may have, notwithstanding the above noted terms and conditions.
Information you provide.
You are solely responsible for any and all information that you provide to us including but not limited to information and measurements with regard to weight, length of time in a wheelchair, age, condition, cause of your condition, sitting waist size, laying waist size, before or after meals waist size, inseam; preference and choice of fabric, color of fabric, loops (number and placement), pockets, zippers, closures, custom additions and all other information you provide. In addition, you allow us to record our conversations for future reference in the event of a dispute regarding the product you ordered and received. In the event we erred in the production of your apparel and it is clearly documented that we were in error, we will re-fabricate the apparel for you at no cost to you.
